Welcome to Rival Ranks, operated by ZDTech Group Ltd ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Rival Ranks mobile application, website, and related services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms, our Privacy Policy, End User License Agreement (EULA), and Community Guidelines. If you do not agree, do not access or use the Services.

We may update these Terms periodically. We will notify you of material changes via email, in-app notifications, or by posting on our website. Your continued use after such changes constitutes acceptance.

1. Eligibility

To use the Services, you must be at least 13 years old (or 16 in certain jurisdictions). If under 18, you must have parental or guardian consent. By using the Services, you confirm you meet these requirements.

2. Account Creation and Responsibilities

You must create an account using Google or Apple sign-in to access most features. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your account credentials.
• Notify us immediately of unauthorized access at support@rivalranks.com.

You are responsible for all activities under your account. We may suspend or terminate accounts for violations of these Terms or our Community Guidelines, based on user reports or admin reviews.

3. User Conduct and Content

You are responsible for all content you post, including profiles, challenges, submissions, questions, answers, chats, tips, tricks, and social media links. You agree not to:

• Post content that is illegal, harmful, defamatory, or infringes intellectual property rights.
• Engage in harassment, bullying, or spamming other users.
• Submit falsified challenge completions (e.g., edited images or false descriptions).
• Use automated tools, bots, or scripts to manipulate the Services.
• Violate any applicable laws or third-party rights.
• Share copyrighted content without proper authorization or attribution.
• Share social media content without permission from the original account holder.

We may review, flag, or remove content and take actions (warnings, suspensions, or bans) based on user reports or admin discretion, as outlined in our Community Guidelines.

3.1 Tips & Tricks and Social Media Content Sharing

When using Tips & Tricks features or sharing social media content:

Content Requirements:

• You warrant that you own or have permission to share all content you post
• Social media links and content must be shared with explicit consent from account holders
• You must provide accurate attribution to original content creators
• Content must comply with applicable copyright laws and platform terms of service

Moderation and Review Process:

• All Tips & Tricks content is subject to automated screening and manual review
• We reserve the right to remove content immediately if it violates policies or laws
• Content may be flagged by users or identified through automated systems
• We may request verification of permissions for shared content

Copyright Compliance:

• We respond to valid DMCA takedown notices and may remove infringing content
• Repeat copyright infringers may have their accounts permanently suspended
• You indemnify us against any claims arising from your shared content
• We may implement content filters to prevent copyright violations

4. Service Features

The Services allow you to:

• Create and update profiles with personal information, images, and preferred game titles.
• Add friends, block users, or report violations.
• Create challenges tied to predefined game titles, set descriptions, and ask/answer questions.
• Participate in challenges, submit completions with images/descriptions, and vote on disputes.
• Engage in chats and receive system or user-generated notifications.
• Share tips, tricks, guides, and social media content with proper attribution and permissions.

Challenges may auto-expire (e.g., if fewer than 3 participants after 50% duration). Submissions are subject to automated checks and user/admin reviews for fairness and copyright compliance.

5. Intellectual Property

We own or license all rights to the Services, including code, designs, trademarks, and content (excluding User Content). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it within the Services to provide features like challenges, profiles, and Tips & Tricks. You confirm your content does not infringe third-party rights and that you have all necessary permissions for shared social media content.

Copyright Protection:

• We respect intellectual property rights and expect users to do the same
• Users sharing copyrighted content must have proper authorization
• We maintain a copyright infringement policy with escalating penalties
• Content creators can report unauthorized use of their material

6. Account Termination and Deletion

You may delete your account via the in-app "Delete Account" screen or at https://account.rivalranks.com. We may terminate or suspend your account for violations of these Terms or our Community Guidelines, with or without notice, including for:

• Repeated copyright infringement violations
• Sharing unauthorized social media content
• Violations of Tips & Tricks content policies
• Other breaches of these Terms or Community Guidelines

Upon termination, your access to the Services ends, and we may remove your content.

7. Disclaimers

The Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or fitness for a particular purpose. We are not responsible for third-party content, services, linked sites, or user-shared social media content. We do not warrant the accuracy or legality of user-generated Tips & Tricks content.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages (e.g., loss of data, profits, or copyright claims arising from user content). Our total liability is limited to $100 or the amount you paid us in the past 12 months, whichever is greater.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Services, your content (including shared social media content and Tips & Tricks), violations of these Terms, or infringement of third-party rights, including legal fees and damages.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Delaware, USA. Any disputes will be resolved through binding arbitration in Lewes, DE, except for small claims court matters and intellectual property disputes. You waive the right to participate in class action lawsuits.
